Ojo put out an advertisement for the sale of his black BMW car at the cost of N500,000. Ejiro saw the advertisement and expressed his desire to buy the black BMW car for N400,000 instead. Ojo accepted Ejiro's counter-offer and asked his lawyer to draft an agreement covering the sale. Instead of drafting an agreement for the sale of the black BMW car, the lawyer incorrectly drafted a contract for the sale of Ojo's new black Bugatti car (worth N40,000,000) for N400,000. While Ojo did not notice this error, Ejiro noticed the error and was silent about it. Both parties signed the written contract, and Ejiro paid the stipulated N400,000 to Ojo. Upon discovering the error in the contract much later, Ojo is sad and confused, but Ejiro is happy and intends to enforce the performance of the written contract and acquire the new Bugatti on the basis that the contract is a valid and properly signed one.MY QUESTION IS THIS:
how can we state whether or not the contract can be rectified to preserve and give effect to the original oral agreement between Ojo and Ejiro.
